💬 Exclusivite Spa Testimonial Submission Terms & Conditions
By submitting a testimonial to Exclusivite Spa (“we,” “us,” “our”), you agree to the following terms and conditions:
1. Eligibility and Accuracy
You confirm that all information you submit, including your name, credentials, testimonial text, photos, videos, and ratings, is truthful, accurate, and your own original work.
You also confirm that any before and after photos accurately represent your results and have not been digitally altered.
2. Consent to Use
You grant Exclusivite Spa a perpetual, royalty-free, worldwide, irrevocable, and non-exclusive license to use, reproduce, modify, publish, distribute, and display your testimonial. This includes the text, photos, videos, and any personal identifiers you provide.
This license applies across all digital and physical platforms, including our website, social media, email campaigns, advertising, and marketing materials.
We may crop, resize, translate, caption, or adapt your content as needed for these uses.
3. Personal Information
We will use your personal information, such as your name or social handle, only in connection with your testimonial and as outlined in our Privacy Policy.
You may request that your name or identifying details be removed or anonymized by contacting us directly.
4. No Compensation and No Obligation
Unless otherwise stated on the submission form, you acknowledge that you have not received payment or compensation beyond nominal gifts such as samples or discounts.
You understand that you will not receive additional compensation for any future use of your testimonial.
5. No Confidential or Third-Party Information
You confirm that your testimonial does not contain confidential information or content belonging to any third party.
You also confirm that its publication does not violate any rights of others.
6. Privacy and Data Use
Your use of our submission form and the information you provide are governed by our Privacy Policy. This policy explains how we collect, use, and protect your data.
7. Indemnification
You agree to indemnify and hold harmless Exclusivite Spa and its affiliates from any claims, damages, or legal expenses resulting from your testimonial. This includes claims related to intellectual property or privacy violations.
8. Limitations of Liability
If there is a dispute about your testimonial, your only remedy is to request that we remove it from our materials.
We are not responsible for any indirect, special, or incidental damages related to your submission or its use.
9. Removal and Withdrawal
We may choose to accept, reject, or remove any testimonial at our discretion, either before or after it is published, and without prior notice.
You may request the removal of your testimonial by contacting us. We will remove it promptly, but we cannot guarantee removal from third-party platforms or previously shared content.
10. Governing Law
These terms are governed by the laws of Ontario and Canada. Any legal disputes will be handled in the courts located in the Greater Toronto Area.
11. Changes to These Terms
We may update these terms from time to time. The version in effect at the time of your testimonial submission will apply.
